ANJANA PRAKASH ORAL JUDGMENT Date: 31-03-2015 The petitioner seeks quashing of the order of cognizance dated 19.02.2011 passed by the Chief Judicial Magistrate, Patna in S.K. Puri P.S. Case No. 192 of 2010 G.R. No. 6231 of 2010. The case of the complainant is that on the date of occurrence the petitioner called him in his cabin and asked him in a derogatory manner to give his resignation. He also misbehaved with him.
It has been submitted on behalf of the petitioner that fact of the matter is that complainant's services were terminated on account of his irresponsible, unprofessional behaviour and bad attitude and being aggrieved by such action he has filed this complainant against the accused person who do not reside within the state of Bihar in order
Patna High Court Cr.Misc. No.23520 of 2012 dt.31-03-2015 2/2 to teach them lesson.
On the last occasion notices have been issued to the O.P. No. 2 but he has not chosen to appear.
Having considered the facts of the case and also the statement of the witnesses during investigation the application is allowed and the order of cognizance dated 19.02.2011 passed by the Chief Judicial Magistrate, Patna in S.K. Puri P.S. Case No. 192 of 2010, is hereby quashed.
