The petitioners seek bail in connection with Rajgir P.S. Case No. 143 of 2017 registered under Sections 304(B)/34 of the Indian Penal Code.

The petitioners along with other accused persons are said to have committed murder of daughter of the informant by assaulting her by means of lathi and pressing her neck over dowry demand.

It is submitted by learned counsel for the petitioners that the petitioners happen to be parents-in-law of the deceased. The allegation levelled against the petitioners is not

Patna High Court Cr.Misc. No.58554 of 2017(4) dt.02-02-2018 2/2 specific rather omnibus. They neither made any demand nor took part in any sort of occurrence. All the witnesses examined by the I.O. are hearsay witnesses. The informant in his written report stated that he had got knowledge of murder of his daughter by all the accused persons from his three years old Natni (grand-daughter) but said Natni (grand-daughter) of the informant has not been examined by the I.O. The petitioners have been languishing in custody since 22.06.2017. Similarly situated co-accused namely, Vikash Ram @ Vikash Kumar has been enlarged on bail vide order dated 22.09.2017 passed in Cr. Misc. no. 143 of 2017 by a co-ordinate Bench of this Court.

In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Nalanda at Biharsarif in connection with Rajgir P.S. Case no. 143 of 2017.
