JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-07-2020 Heard Mr. Uday Kumar, learned Advocate for the petitioner and Mr. Ram Priya Sharan Singh, learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Dumra P.S. Case No. 310 of 2019 dated 09.08.2019 instituted for the offences under Sections 366(A) and 363 of the Indian Penal Code.
The allegation against the petitioner is of abducting the victim with malicious intent.
The learned counsel for the petitioner has drawn the attention of this Court to the 164 statement of the victim girl who has denied that she was kidnapped/abducted by anybody forcibly. She has stated that
about ten days before her making the statement, she had gone to Hyderabad along with the petitioner of her own volition. Regard being had to the aforesaid facts and also taking into account that there could be a possibility of false implication, the petitioner is directed to be released on bail, in the event of his arrest/surrender before the court below within a period of six weeks, on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 310 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
