JUSTICE SUDHIR SINGH ORAL ORDER 27-06-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 148, 149, 341, 323, 307 and 504 of the Indian Penal Code.
Allegation against the petitioners is that they assaulted the informant and his family members.
It is submitted on behalf of the petitioners that they have got no criminal antecedent. It is a case and counter case between the parties. Petitioner nos. 1 and 2 are ladies. After investigation police has submitted Chargesheet under bailable offence. The court below has differed from the said police report and has taken cognizance under Section 307 of the Indian Penal Code. Both the parties are said to have received injuries in course of occurrence. On behalf of the State, it is submitted that petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of six weeks, be released on bail
Patna High Court Cr.Misc. No.21518 of 2016 (3) dt.27-06-2016 2/2 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sheikhpura, in connection with Ariari P.S.
