====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 26-03-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is seeking anticipatory bail in connection with Salakhua P.S. Case No. 174 of 2018 registered under Sections 498(A), 364, 364/34 of the Indian Penal Code subsequently added section 304(B), 302, 201 of the Indian Penal Code.
The case of the prosecution is that the daughter of the informant was married 4 years ago with Amar Yadav as per Hindu Rituals. At the time of marriage the informant gifted many valuable articles including Rs. 75,000/- cash. The husband of the victim Bebi Devi demanded motorcycle for which Rs. 60,000/- was also paid by the informant but the accused person were not ready to keep her saying that she is not beautiful
Patna High Court CR. MISC. No.16679 of 2019(2) dt.26-03-2019 2/3 though she was pregnant of four months. When she was given poisonous sweet to eat she fled away from the house at the house of cousin mother-in-law and since then she is traceless and thereafter informant lodged the present case being Salkhua P.S. Case No. 174/2018 against the accused persons. Learned counsel for the petitioner submits that the petitioner is Dewar of the of the deceased and has been falsely implicated in this case and one of the Dewars of the deceased has been granted privilege of anticipatory bail by learned coordinate Bench of this court in Cr. Misc. No. 6786/2019 vide order dated 06.02.2019, and also petitioner has no criminal antecedent.
Learned AP.P. for the State has opposed the prayer for anticipatory bail of the petitioner.
Considering the facts and circumstances whereunder petitioner is said to be the Dewar of the deceased and that one of the Dewars of the deceased had granted privilege of anticipatory bail by learned coordinate Bench of this court in Cr. Misc. No. 6786/2019 vide order dated 06.02.2019, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the
