JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2015 Heard learned counsel for the petitioners and learned counsel for the State The petitioners are apprehending their arrest in connection with Dinara P.S. Case No. 190 of 2011 for the offences instituted under Sections 387, 504 and 354/34 of the IPC. The prosecution story, in brief, is that the informant Manju Devi, Headmistress, High School, Karanj, had filed a written report before the Dinara Police Station stating that the Chairman of the School and local Mukhiya arrived at her School and demanded Rs. 10,000/- as "Rangdari" and when she refused they abused and misbehaved with her in presence of other teachers.

Patna High Court Cr.Misc. No.26470 of 2015 (3) dt.23-09-2015 2/2 It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. It is further submitted that the petitioners have falsely been implicated in the present case due to mistake of fact. The demand of "Rangdari" has been denied on behalf of the petitioners. It is further submitted that the petitioners made a complaint against the informant after institution of the present F.I.R.

On behalf of the State it has been submitted that there is direct allegation of demanding "Rangdari" against the petitioners from the informant who is the Headmistress of the High School. Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioners. The same is rejected in Dinara P.S. Case No. 190/2011, pending in the court of the learned S.D.J.M., Bikramganj, Rohtas. Anyhow, if the petitioners surrender in the court below within a period of six weeks from the date of receipt/production of copy of this order the same shall be considered on its own merit preferably on the same day without being prejudiced by this order.
