Petitioner, already in custody, seeks bail in connection with Ram Krishna Nagar P.S. Case No.318 of 2017 registered under Sections 399 and 402 of the Indian Penal Code as well as under Sections 25(1-b)a, 26, 35 of the Arms Act. Allegation in brief is that petitioner and some other miscreants were apprehended by the police and it is alleged that they were making plan for committing dacoity and one loaded country made pistol with one live cartridge were recovered from possession of the petitioner and some arms from others. Learned counsel for the petitioner submits that the petitioner has been in custody in this case since 01.11.2017 and still charge has not been framed, though he has criminal

Patna High Court Cr.Misc. No.40735 of 2018(2) dt.10-07-2018 2/2 antecedent of three cases but in two cases he was remanded after institution of the present case.

Having considered the aforesaid facts and circumstances as well as the period of custody, petitioner Manish Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XIII, Patna in connection with Ram Krishna Nagar P.S. Case No.318 of 2017.
