JUSTICE RAKESH KUMAR ORAL ORDER 25-07-2016 Sri Vijay Krishna Tiwary, learned counsel for the petitioner, in presence of Sri T.P.Mandal, learned Addl. Public Prosecutor, fairly accepts that during pendency of this petition, only recently charge has already been framed, whereas the present petition was filed against the order of rejection of discharge petition.

In view of the fact that charge has already been framed, meaning thereby that trial has commenced, there is no need to keep the matter pending. The petition stands disposed of with liberty to the petitioner to raise all the points, which have been raised in the present petition, at the defence stage before the court below.
