JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2015 Learned counsel for the petitioners submits that petitioner no.2, Rana Singh has been arrested. As such, the instant application against petitioner no.2 has become infructuous. The same stands dismissed as infructuous.

Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Section 304(B)/34 of the Indian Penal Code. It is alleged by the informant that the deceased Priyanka Singh was married with one Ravinder Singh on 19.02.2009 and after one year of marriage Ravinder Singh started demanding rupees one lack and one motor cycle as dowry and started cruelty physically and mentally with the deceased and on

09.02.2015 informant got information on telephone that deceased got burnt while she was cooking food.

Petitioner no.1 is the husband, petitioner no.3 is the mother-in-law and petitioner no.4 is the Nanad of the deceased. It has been submitted that the present case was instituted by the mother of the deceased on 03.04.2015 in respect to occurrence which had taken place on 09.02.2015 after a period of two months. Prior to the institution of the present case, the father of the deceased got a U.D. case instituted on the date of occurrence itself, i.e., on 09.02.2015 which is Annexure-2 to the present application where he has stated that the deceased died due to accident.

It has been submitted on behalf of the State that the petitioners are named in the FIR.

Considering the aforesaid facts, let the petitioners, namely, Rawindar Singh @ Ravindra Singh, Kaushalya Devi @ Kaushalaya Devi and Priyanka Kumari @ Priyanka Kumar in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Deo P.S.Case No.17 of 2015,

subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
