JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-01-2023 Heard learned counsel for the petitioner, learned counsel for the State and perused the case diary. The petitioner is in custody in a case registered for the offence punishable under Sections 149, 342, 450, 376(DB), 302, 201 and 102(B) of the Indian Penal Code and Sections 4 and 5 of the POCSO Act.

It is alleged by the informant that he is the resident of Nepal and works as a tea hawker in the local market of Chainpur and the informant and his wife went to Nepal, his minor daughter aged about 12 years, stayed in the rented house was raped and murdered and her dead body was cremated forcefully by the accused persons.

Learned counsel for the petitioner submits that

He further submits that the case was being investigated but in the meantime, an audio clip went viral in which conversation of petitioner and a local representative who alleged to have talked with the petitioner over the phone on the date of occurrence and alleged to cooperate for disposing of the dead body of the victim girl flashed and on that basis without verifying the genuineness of the alleged conversation, the Sub Divisional Police Officer, Sikharna the petitioner was implicated in this case. He further submits that the petitioner is not named in the FIR and except for alleged conversation, nothing has come against the petitioner to attribute the involvement of the petitioner in the alleged crime. Petitioner is in judicial custody since 17.02.2022. Learned APP appearing for the State has opposed the prayer for regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-VI-cum-Special Judge, POCSO Act, East Champaran,
