Submission is that the petitioner was on bail during the course of investigation and the police after investigation submitted charge sheet under bailable Sections of the Indian Penal Code, but the learned Chief Judicial Magistrate took cognizance under Section 302 and other Sections of the Indian Penal Code.

Learned counsel for the petitioner seeks permission to withdraw the anticipatory bail petition.

Prayer is allowed.

The petition stands dismissed as withdrawn.
