The petitioner is apprehending arrest in a case registered for the offences punishable under Section 354 of the Indian Penal Code and sections 11,13,15 of The Protection of Children from Sexual Offences Act, 2012.
It is alleged against the petitioner that the petitioner made an attempt to outrage the modesty of the petitioner. It is submitted by learned counsel for the petitioner that since the petitioner lodged a complaint against the father of the informant before the 'Sarpanch' hence, the present case has been lodged. Even assuming the accusation, no offence under sections 11,13,15 of The Protection of Children from Sexual Offences Act, 2012 is made out against the petitioner. A
Patna High Court Cr.Misc. No.30727 of 2015 (2) dt.31-07-2015 2/2 statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Mahila P.S. Case No.4 of 2015, pending before the learned Chief Judicial Magistrate, Gaya.
With the above observation, this application is, accordingly, disposed off.
