4. This Court has heard Mr. P. N. Shahi, learned Sr. Advocate along with Mr. Shashi Bhushan Singh, learned Advocate for the petitioners. The Universities are also represented through their respective counsels. Learned Advocate for the State is also present.

The batch of the writ petitioners, including the Sambadh Degree Mahavidyalaya Seva Sangh, a registered association, bearing registration no. 183/4/2018, have approached this Court for the following reliefs: (i) For issuance of an appropriate writ in the nature of Mandamus, Commanding and directing the respondent authorities to release the necessary funds/grants to the respondent Universities for payment of current and arrears of salary to the teaching employees of the petitioners' colleges in the light of judgment passed in LPA No. 683/2023, dated 30.04.2025 upheld by the Hon'ble Supreme Court in SLA 23633/2025, order dated 29.09.2025, who have appointed on sanctioned vacant post in the light of provisions contemplated in Bihar Universities Act, 1976 and also following the statutory provisions the services have been approved by the competent authorities.

(ii) For a direction to the respondent to grant pensionary benefit to the teachers of the

11/15 petitioners' colleges on account of retirement after completion of 65 years as the procedure of appointment and approval of service every thing is same as to the case of L.P.A. No. 683/2023 in which the Hon'ble Division Bench in judgment dated 30.04.2025 has held that the distinction between colleges getting deficit grant and colleges getting grant against performance was absolutely unwarranted and uncalled for.

(iii) For issuance of a direction to the respondent authorities concerned to maintain parity with the teaching employees of the petitioners' colleges with the employees who appointed and subsequently their services have been approved in view of Bihar State Universities (Amendment) Act, 2015."

6. Learned Senior Advocate representing the petitioners has raised various claim and submitted that identical issue has come up before this Court in C.W.J.C. No. 250 of 2019 and analogous case i.e. C.W.J.C. No. 2019, which came to be disposed of on 01.02.2023, wherein the Court while disposing of the writ petition has observed as follows: "It appears that the University has conducted that exercise and has made recommendations but the State Authorities did not accept it on a ground that the aid released is under the deficit grant and not under the grant against performance. Although, such a

12/15 submission has been made before this Court and in the counter-affidavit the orders impugned do not reflect such a reason. Be that as it may, this Court is satisfied that there is no difference mentioned in the provision added to Section 57(A) vide notification dated 27th August 2015 and no distinction can be drawn between the teachers who are appointed without recommendation of the Bihar College Service Commission for the purpose of scrutinizing their cases or for the purpose of releasing the grant. Such an approach adopted by the State Government has resulted in unnecessary litigation before this Court. The action of the State is found to be wanting and in view of above, the impugned orders passed by the respondent dated 23.09.2018 as well as the orders passed subsequently dated 06.10.

2022 by the Director are quashed and set aside with further direction to release the grant to the concerned University for further distribution of salary and other allowances to the petitioners. Those who have retired shall also be granted their due pensionary benefits in terms of the U.G.C. pay scales. The exercise shall be conducted positively within a period of one month from today."

7. Aggrieved with the order aforenoted, the State has preferred L.P.A. No.683 of 2023 as well as L.P.A. No. 690 of 2023 wherein the learned Division Bench of this Court while

13/15 disposing of the appeals has held as follows: "19. Since by the amendment in sub-Clause 6 of Section 57-A of the Act of 1976, it was declared that the distribution of the amount of grants sanctioned by the State Government will be made amongst the teachers of the concerned affiliated degree colleges by its Governing Body up to 31.03.2017, which was later extended till 31.03.2018, the learned Single Judge categorically held, and in our opinion, rightly so, that for grant of finances, the distinction between colleges getting deficit grant and colleges getting grant against performance was absolutely unwarranted and uncalled for.

This distinction only reflected the blinkered approach of the Department.

20. Thus, the teachers of all the affiliated degree colleges appointed prior to 19.04.2007 were covered by the Amending Act of 2015 and the distinction which was carved out by the State of limiting this benefit only for teachers of such degree colleges which were getting grant against performance of the students in such colleges, is not only illusory but iniquitous.

21. The State, thus, and as held by the learned Single Judge would be under an obligation to release the grant to the concerned Universities for further distribution of salary and other allowances to the writ petitioners. It

14/15 was also clarified by the impugned judgment that those teachers who had retired shall also be granted their due pensionary benefits in terms of the U.G.C. pay scale. This exercise was to be conducted positively within a period of one month."

8. The State on being dissatisfied preferred Special Leave to Appeal (c) No(s). 23633 of 2025, however, the same came to be dismissed.

9. Referring to the aforenoted decisions, learned Senior Advocate for the petitioners thus submits that the petitioners are also entitled to the benefits, as has been claimed for in the writ petition.

On the other hand, learned Advocate for the Universities submitted that in the light of the orders passed by this Court, as also considering the claim of the various identically situated persons, a 9 Men Committee, headed by the Chief Secretary has been constituted, to consider the identical grievance raised by the petitioner under Memo No. 2829 dated 30.09.2025. The petitioners before invoking the writ jurisdiction of this Court has also approached before the 9 Men Committee by filing a detailed representation under letter no. SDMSS/06 dated 10.10.2025. Since, the representation of the petitioners is under consideration before the competent committee, who shall

15/15 look into the matter and take appropriate decision is the contention of the learned Advocate for the respondents.

Having considered the submissions advanced by the learned Senior Advocate/Advocate for the respective parties and upon perusal of the materials available on record, this Court instead of directing the respondents to ensure filing of the counter affidavit deems it fit and proper to dispose of the writ petition with a direction to the concerned State authorities, especially respondent no.14, to consider the representation of the petitioners, the copy of which is marked as Annexure-P/12 to the writ petition, and bring to its logical conclusion preferably within a period of twelve weeks from the date of receipt/production of a copy of this order.

12. Suffice it to observe that in case the grievance of the petitioners finds favour, necessary consequential order shall also be passed within the period aforenoted.
