Petitioner seeks bail in a case registered for the offences punishable under Section 170, 171, 212 of the Indian Penal Code, Section 25(1-b)a/26/35 of Arms Act and 17 of C.L. Act. The first information report goes to show that nothing was recovered from the conscious possession of the petitioner nor petitioner was caught on the spot. The name of the petitioner came in confessional statement of one co-accused, Manish Kumar, who has already been granted privilege of bail by a co-ordinate Bench of this Court in Cr. Misc. No.453 of 2018 vide order dated 22.05.2018.

Considering the aforesaid facts and circumstances as well as

No.43742 of 2018 (2) dt.23-07-2018 2/2 submissions of the parties, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VII, Aurangabad in connection with Kutumba P.S.
