JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-08-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 307 and other ancillary sections of the Indian Penal Code.

Prosecution case is that 12 unknown persons attacked on the police party and fled away with the seized tractor engine. Chaukidar disclosed name of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. Petitioner has got no criminal antecedent.

Learned counsel appearing for the State opposes the prayer for bail. He submits that it was the petitioner who took

Considering the specific allegation against the petitioner, his prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
