The petitioner seeks bail in connection with Magadh Medical P.S. Case No.454 of 2023 registered for the offence under sections 323, 376-D of the Indian Penal Code and under section 4/6 of the POCSO Act.

The petitioner is accused of committing rape upon the victim along with his two brothers.

The petitioner is in custody since 05.01.2024. During investigation, it has come that the petitioner was in relationship with the victim and because of the same, this false case has been lodged against the petitioner and his brothers.

Considering the aforesaid facts, this bail application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO-cum-Additional District & Sessions Judge, VI, Gaya in connection with Magadh Medical P.S. Case No.454 of 2023.
