JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 25-03-2015 It has been submitted on behalf of the petitioner no. 1 that he has been arrested and on account thereof, instant petition has become infructuous. Hence, be permitted to withdraw and is, accordingly, allowed.

Heard learned counsel for the petitioners as well as learned A.P.P. for the State.

Laxmi Devi, who was married with Sudhir Kumar Yadav about six years ago, was murdered at her Sasural and on account thereof, instant case has been registered at the instance of her father wherein he has specifically alleged that Sudhir Kumar Yadav advanced his demand relating to a she-buffalo as well as golden ring and to facilitate the same, deceased was also tortured.

Furthermore, it is apparent from Annexure-3 (chargesheet), they were not sent up for trial, however, differing therefrom the learned Chief Judicial Magistrate summoned them. In the aforesaid facts and circumstances of the case, petitioners namely, Bochai Yadav, Ranjila Devi, Anita Devi are directed to be released on bail in the event of their arrest or surrender within four weeks on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 210 of 2012 in terms of condition so enumerated under Section 438(2) Cr.P.C. (Aditya Kumar Trivedi, J.) Vats/- U T
