The petitioner seeks bail in Patepur P.S. Case No. 178 of 2018 registered for the offence under Sections 395 and 397 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, in the night, when the informant was returning from his shop, some accused persons fired at him and his other associates as a result of which one Santosh Kumar Rai succumbed to the injuries. The accused persons looted Rs.35,000/- and other articles of the informant. It is submitted on behalf of the petitioner that petitioner is not named in the F.I.R. and his name transpired during the course of investigation on the confessional statement of co-accused Manish Kumar, who has already been granted bail by this Hon'ble Court vide order dated 02.05.2019 passed in Cr.

Patna High Court CR. MISC. No.17279 of 2022(2) dt.25-05-2022 2/2 Misc. No. 18315 of 2019. Petitioner is in custody since 04.12.2021.

Learned APP vehemently opposes the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hajipur in connection with Patepur P.S. Case No. 178 of 2018.
