2. The petitioner seeks bail in a case registered for the offence punishable under Sections 448, 354(A) and 354(B) of the Indian Penal Code.

3. Petitioner is said to have entered into the room of the informant and caught her with bad intention and tried to commit rape upon her.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the victim girl has made accused the petitioner on the basis of suspicion and earlier grudge as both are residing on the same village. He submits that no offence under POCSO Act is made out against the petitioner. He further submits that petitioner has no criminal antecedent as stated in

Patna High Court CR. MISC. No.21403 of 2024(3) dt.10-04-2024 2/2 para-3 of the bail application and he is languishing in judicial custody since 21.12.2023.

5. Learned APP for the State opposes the prayer for bail.

6. Considering the facts and circumstances of the case and the period of custody, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Amas P.S. Case No. 324 of 2021.
