The petitioner apprehends his arrest in a case under Sections 406, 420 of the Indian Penal Code and Section 138 of the N.I. Act.

The gist of the allegation is that the complainant deposited money in D.G.S. Co-operative Bank and after maturation, the petitioner gave a cheque of Rs. 1,15,000/- but the same was dishonoured. Learned counsel for the petitioner submits that the petitioner is ready to return the money within two months. Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt

No.26641 of 2015 (2) dt.17-07-2015 2/2 / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Javed Alam, Judicial Magistrate, 1st Class, Muzaffarpur in Complaint Case No. 3464/12, corresponding to Tr. No. 1507/15, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and with a further condition that the petitioner returns Rs. 1,15,000/- to the complainant within two months of his release. If the petitioner fails to return the money to the complainant within the stipulated period, his bail bonds shall be cancelled.
