The petitioner seeks bail in a case registered under Sections 20, 22, 24, 27A, 29 of NDPS Act & 25(1-B)a, 26 of the Arms Act.

Allegedly, 850 gms Charas was recovered from the Dikki of motorcycle of the petitioner.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 30-05-2018. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. The amount of recovered Charas is 850 gms. The same is below the commercial quantity.

Patna High Court CR. MISC. No.17351 of 2019(4) dt.25-04-2019 2/2 Hence Section 37 of the NDPS Act is not applicable in the present case. There is no compliance of Section 100 Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, West Champaran at Bettiah in connection with Trial No. 35 of 2018, N.D.P.S. Case No. 41 of 2018 arising out of Majhauliya P.S. Case No. 201 of 2018.
