Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioners seek bail in connection with Kotwali P.S. Case No. 576 of 2022 registered for the offence under Sections 399/402/414/420/465/467/468/471 of the Indian Penal Code and 25(1-b)A/26/35 of Arms Act.

The prosecution story in short is that on 20.09.2022 at 4.00 A.M., the informant moved in the field with police party

Patna High Court CR. MISC. No.24010 of 2023(2) dt.18-05-2023 2/3 for arrest of accused but he got secret information that some accused persons are making plan near G.P.O. Golamber for Loot. Further, he reached near G.P.O. golamber at 4.20 A.M. and after seeing the police, some accused persons were trying to run away. Further, he caught three accused persons with the help of police party and after search one country made pistol and 315 bore live cartridge recovered from the pocket of the accused Jitendra Kumar Yadav and one mobile recovered from the possession of the accused Avinash Gawala @ Shumbham and one motor cycle.

Learned counsel for the petitioners submits that the petitioners are in custody since 21.09.2022.

Learned A.P.P. has vehemently opposed the prayer for bail.

The petitioners are accused in six more cases. All the cases have been registered in the town of Patna. Considering the aforesaid facts and the criminal antecedent, I am not inclined to grant bail to the petitioners. The District Judge, Patna is directed to transfer all the cases registered against the petitioners in one Court so that the trial of the petitioners in all the cases be expedited.
