The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 147, 148, 149, 323, 307, 504 and 379 of the Indian Penal Code. Learned counsel for the petitioner seeks permission to withdraw the anticipatory bail application with respect to petitioner No. 3.

Permission is accorded.

The informant alleges that his uncle was assaulted by

Patna High Court CR. MISC. No.21410 of 2023(2) dt.27-06-2023 2/3 the accused persons including the petitioner and while fleeing, one of the accused Manoranjan Pal fired and they also took Rs. 20,000/- from the pocket of his uncle.

Learned counsel for the petitioner next submits that the petitioner No. 2 and 4 are persons with clean antecedent and petitioner No. 1 has antecedent of one case.

Learned counsel next submits that the petitioners have been falsely implicated in the present case, it is next submitted that from bare perusal of the allegations as alleged in the FIR, it would manifest that the allegation of assault is not specific, rather, is general and omnibus in nature, it is next submitted that even presuming what has been alleged is true without admitting, then the injuries suffered by the injured is simple in nature. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where
