Mr.Murli Dhar ====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 19-05-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Barachatti P.S. Case No.320 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner. The petitioner is not the owner of the vehicles in question and he has no concern with the seized lilquor. The name of the petitioner has surfaced in this case on the basis of confessional statement of co-accused. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances

Patna High Court CR. MISC. No.17833 of 2023(3) dt.19-05-2023 2/2 of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Additional Sessions Judge-cumExclusive Special Excise Court No.II, Gaya in connection with Special (Excise) Case No.950 of 2021 arising out of Barachatti P.S. Case No.320 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
