The petitioner apprehends his arrest in Makhdumpur (Tehta) P.S. Case No. 17/2015, registered for the offences punishable under Sections 307 and other Sections of the Indian Penal Code.
The informant made allegation that Samjit Yadav assaulted him with fists on his lips and thereafter Tenni Yadav, Mahesh Yadav @ Benga and Akhilesh Yadav assaulted him with stick and iron rod on his head.
It is submitted that the informant got two lacerated wounds and complain of pain all over the body. The injuries are simple in nature. Similarly situated co-accused Akhilesh Yadav
Patna High Court Cr.Misc. No.27310 of 2015 (2) dt.21-07-2015 2/2 and Mahesh Yadav have already been granted anticipatory bail vide order dt. 22.05.2015 passed in Cr. Misc. No. 22504 of 2015. It appears that the case of the petitioner stands on the same footing.
Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Makhdumpur (Tehta) P.S. Case No. 17/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
