The petitioners, namely, Ajay Yadav and Ravindra Yadav, apprehend their arrest in a case registered under Section 387 and other sections of the Indian Penal Code and Section 3(i)(x)(xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Learned counsel for the petitioners submits that the petitioners are named in the F.I.R. but the police, after investigation, did not find the case true against the petitioners. The police found the case true only against Bidyanand Yadav, Bijay Yadav and Raja Yadav, but cognizance has been taken against the petitioners.

Considering the fact that the police, after

No.34157 of 2014 (2) dt.10-02-2015 2/2 investigation, did not find the case true against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in Bhagalpur SC/ST P.S. Case No. 40/2007, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
