JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2017 The petitioner seeks regular bail in connection with Chausa P.S. Case No. 107 of 2017, registered for offences punishable under Sections 302, 201, 120(B) and 34 of the Indian Penal Code.

Allegation as per F.I.R that the petitioner and one Rajesh Bhagat was seen by the deceased in objectionable condition and he protested and, thereafter, the petitioner and other accused persons killed the deceased by pressing his neck. It has been submitted on behalf of the petitioner that she happens to be sister of the deceased and has falsely been implicated in this case and in fact she has no role to play in the death of the deceased. Further other co-accused persons having similar allegation has already been enlarged on bail by this Court

vide order dated 05.09.2017 passed in Cr. Misc. No. 38284 of 2017.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts as well as in view of the fact that other co-accused persons have already been enlarged on bail, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Udakishungangj, Madhepura, in connection with Chausa P.S. Case No. 107 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make herself available as and when required by the court and on the event of failure on her part to appear before the court below on two consecutive dates without showing any genuine reasons, the

prosecution is free to move for cancellation of her bail bonds.
