2. The petitioner seeks bail, who is in custody since 19.11.2025 in connection with Panapur Kariyat P.S. Case No. 133 of 2025, F.I.R. dated 25.08.2025 registered for the offence under Sections 309(4) & 3(5) of BNS and Section 27 of the Arms Act.

3. The prosecution case, in brief, is that some unknown persons on the gunpoint threatened the informant, fired at him and took away his vehicle. Despite search, the vehicle could not be recovered.

4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. It has been further submitted that the name of the petitioner has been transpired during the course of investigation

It appears from the FIR that initially the petitioner was not named in the FIR. Thereafter, the petitioner has confessed his guilt in the present occurrence. The petitioner has been remanded in the present case from Vaishali P.S. Case No. 644 of 2025 on 19.11.2025. He further submits that the similarly situated co-accused person has been granted bail by this Court vide order dated 17.03.2026 passed in Cr. Misc. No. 16746 of 2026. The police, after investigation, submitted the charge-sheet against the petitioner. The petitioner is languishing in judicial custody since 19.11.2025.

5. Learned APP for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner and submits that petitioner carries three more cases other than the present one but he fairly submits in paragraph 3 of the bail petition that petitioner is on bail in the pending matters.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Panapur Kariyat P.S. Case No. 133 of 2025, with the following conditions:-

No.18925 of 2026(3) dt.01-05-2026 3/3 (I) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be cancelled by the Court below. (II) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.

(III) And, further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage, it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
