The petitioner, who is in custody, seeks bail in connection with Sherghati (Dobhi) P.S. Case No. 58 of 2015 registered for the offence punishable under Sections 364 (A), 120(B)/34 of the Indian Penal Code and 17 C.L.A. Act. The allegation against the petitioner is that the informant was carrying out the cleaning work of Lilagan Canal near Fajlaha village. To supervise the work he had deputed two persons namely Surendra Kumar Yadav and Akhilesh Kumar Verma. On 01.03.2015 at about 11.00 AM two persons came on motorcycle and asked to stop the work and also threatened to damage their machines in case the work resumes and thereafter on
Patna High Court Cr.Misc. No.60822 of 2017 (2) dt.17-01-2018 2/2 03.03.2015four persons armed with weapons came on motorcycle and abducted both workers at the point of pistol and demanded ransom of 16 lacs on phone by the accused persons. Learned counsel for the petitioner submitted that the petitioner is quite innocent and has committed no any offence and has been falsely implicated in this case merely on suspicion. It has further been submitted that similarly situated co-accused persons, namely, Anup Kumar Yadav and Yogendra Yadav have granted bail by a coordinate Bench of this Court vide order dated 15.10.2015 and 10.04.2017 passed in Cr. Misc. No. 46971 of 2015 and 11081 of 2017 respectively. It has further been submitted that petitioner is in custody since 26.05.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Sherghati, Gaya, in connection with Sherghati (Dobhi) P.S.
