One Deepak Kumar was apprehended along with Honda Shine motorcycle bearing Registration No. BRO6AN1260, allegedly a stolen one. On query, he confessed and further disclosed that he had purchased the aforesaid vehicle from Mumtaj Alam. As per instruction, he procured presence of petitioner, Mumtaj and police also seized the motorcycle over which he had come. On query, petitioner disclosed that one Ravindra Sah happens to be the gang leader whereupon, Ravindra was searched who was absent but the stolen motorcycle was also seized therefrom.

From Annexure-3, it is evident that the motorcycle which was seized from the possession of the petitioner was

Patna High Court Cr.Misc. No.59379 of 2017 (2) dt.12-12-2017 directed to be released in favour Md. Abbas who happens to be his brother-in-law.

Accordingly, Mumtaj Alam is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of ACJM-13, Motihari, East Champaran in Chakiya PS Case No. 197/2017. (Aditya Kumar Trivedi, J) perwez U T
