2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 467, 468, 471 and 420 of the Indian Penal Code.

3. As per the prosecution case, petitioner is alleged to have fraudulently got sale deed executed in her favour.

4. Learned counsel appearing for the petitioner submits that informant is claiming that the land in question was sold by the said Deorai Bhagat and his sons to his grandfather namely Bhagwan Mistry in year 1940 and on the basis of the certified copy of the said sale deed firstly Jamabandi was created in the name of his mother Laxmi Dive vide Jamabandi No. 22 and thereafter the said Jamabandi was created in his name and his brothers' name. One Om Prakash Gupta also claimed that the aforesaid land was sold by the said Deorai Bhagat and his sons to his ancestor Birju Prasad in year 1939 and on the basis of the said Jamabandi No. 2 was created in the name of said Birju Prasad and on the basis of the same he

Patna High Court CR. MISC. No.18145 of 2025(2) dt.10-04-2025 2/2 challenged the Jamabandi of the informant vide Jamabandi Cancellation case No. 40 of 2022-23 in which the petitioner also participated as intervener respondent. Said Jamabandi cancellation No. 40 of 2022-23 (Of line) was decided in favour of Om Prakash Gupta vide order dated 29.7.2024. Petitioner has also filed Title Suit in the matter for cancellation of sale deed. Matter is out and out of civil nature and no criminal case is made out against the petitioner. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Danapur, Patna in Danapur Police Station Case No. 482 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
