Learned counsel for the petitioner has stated that the copy of the requisition has not been enclosed along with notice under Section 7 of the Public Demand Recovery Act and therefore, petitioner is not in a position to file his objections under Section 9 of the Act. Learned counsel has therefore, prayed this Hon'ble Court to direct the Certificate Officer to furnish all the documents that the authorities are relying along with the notice under Section 7 of the Public Demand Recovery Act.

3. Having regard to the same, the Certificate Officer (Respondent No. 2) is directed to serve the petitioner the copies

Patna High Court CWJC No.4463 of 2025(2) dt.30-04-2025 2/2 of the requisition as well as other documents that they are relying on. Thereafter grant the petitioner time of four weeks to file his objections under Section 9 of the Public Demand Recovery Act. After filing of the objections under Section 9, the authority shall pass a reasoned order under Section 10 of the Act. Needless to observe that before passing any order the petitioner shall be given opportunity of hearing. The entire exercise to be completed as expeditiously as possible preferably within a period of sixteen weeks from the date of receipt of a copy of this order.

4. With the above directions, the present writ petition stands disposed of. Till such times the final orders are passed the respondents are directed not to take any coercive steps against the petitioner. In case the petitioner does not appear after service of notice or co-operate to the disposal of the case, the Certificate Officer is free to take necessary action in accordance with law.

5. The petitioner is free to raise all issues and the same shall be dealt with by the authority in accordance with law. (A. Abhishek Reddy , J) Raj Ranjan/- U T
