The petitioner seeks bail in a case registered under Sections 143, 144, 158, 290, 414, 272, 273 of the I.P.C. as well as Sections 25(1-b)A, 25-1A, 25-1AA, 25-1AAA, 26, 26(ii), 35, 27 of the Arms Act and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The prosecution case, in short, is that one loaded country made pistol has been recovered from the possession of the petitioner.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.08.2017 and has got no criminal antecedent. Charge sheet has been submitted in this case. There
Patna High Court Cr.Misc. No.58476 of 2017(2) dt.18-12-2017 2/2 is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that one loaded country made pistol has been recovered from the possession of the petitioner. There is no compliance of Section 100 Cr.P.C. Other co-accused has been granted bail vide Cr.Misc.No.54304 of 2017.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Sadar P.S. case No.421 of 2017.
