JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 01-04-2015 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek anticipatory bail in connection with Kotwali P.S. Case No.242 of 2013 registered for the offences punishable under sections 302 read with 34 of the Indian Penal Code.
It has been contended that the informant has even named the petitioners in the FIR on the basis of assumption and presumption. No cogent material has transpired in course of investigation as against these two petitioners. There are witnesses who have taken name of Raju Ram, Jaiki Ram and Ganga Ram being the miscreants involved in committing the crime.
Patna High Court Cr.Misc. No.35769 of 2014 (3) dt.01-04-2015 2/2 Learned counsel for the State has opposed the prayer for bail.
Be that as it may, taking into consideration the seriousness of the allegation, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, the prayer for bail is rejected.
In the case the petitioners surrender and seek bail, the same shall be considered on its own merits without being prejudiced in any manner by this order.
