The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 171H, 188, 147, 149 and 353 of the Indian Penal Code.
Prosecution case is that petitioner no.2, being candidate in 'Panchayat' election and petitioner no.1, being wife of petitioner no.2, were distributing money to the voters on the eve of 'Panchayat' election when the informant being Block Development Officer reached there then supporters of the petitioners raised slogans but when police force reached then the accused persons flee away from there.
It is submitted by learned counsel for the petitioners that neither any money was seized nor anyone suggested that the
Patna High Court Cr.Misc. No.23816 of 2016 (2) dt.26-05-2016 2/2 petitioners were distributing money to them. Though, only one Bolero four wheeler and an auto rickshaw fitted with mike, were seized.
Considering the nature of accusation, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-III, Gaya, in connection with Belaganj P.S. Case No.112/2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
