JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-02-2023 The present writ petition has been filed seeking the following reliefs:- "1(I). For directing the respondents concerned specially Director General of Police-cum-Inspector General of Police, Bihar Patna and Superintendent of Police, Economic Offence, Bihar, Patna to enquire into

Patna High Court CWJC No.14313 of 2014(2) dt.28-02-2023 2/3 the matter after lodging an FIR about the huge property acquired by Santosh Kumar, Executive Engineer, Gardanibagh Building Division, Patna respondent no.9 which are disproportionate to the known sources of income.

And also for directing the respondents concerned specially the Chief Secretary, Government of Bihar Patna and Principal Secretary, Building Construction Department to punish Santosh Kumar, Executive Engineer, Gardanibagh Building Division for committing misconduct, suppressing the material facts in declaring assets and liabilities which has been acquired by Santosh Kumar, Executive Engineer, Gardanibagh Building Division respondent no.9 by illegal means in discharging the duty of the government servant in Building Construction Department after initiating departmental proceeding under the Bihar Civil Services Classification Control & Appeal Rules 2005.

(III). Also directing the respondents to take appropriate action in attaching

Patna High Court CWJC No.14313 of 2014(2) dt.28-02-2023 3/3 the property of Santosh Kumar Executive Engineer, Gardanibagh Building Division, Patna which are disproportionate income from the known sources of income on the basis of representation made by the petitioner as contained in Annexureand also for taking appropriate action."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are available under the law. Liberty, so sought, is granted.

The writ petition stands disposed off as not pressed.
