The petitioner apprehends his arrest in G.B. Nagar P.S. Case No.259 of 2018 registered under Sections 413, 414 and 34 of the Indian Penal Code.

On secret information about keeping a stolen motorcycle in the house of Vijay Prasad, the police raided the house and apprehended Vijay Prasad while he was trying to flee away. One motorcycle was also recovered. Vijay Prasad is said to have disclosed that the petitioner had kept the motorcycle in his house for selling.

Learned counsel for the petitioner submits that the petitioner has no manner of concern with the motorcycle recovered from the house of Vijay Prasad. No stolen article has

Having considered the facts that no stolen article has been recovered from possession of the petitioner and the name of petitioner surfaced in the case on the basis of disclosure made by Vijay Prasad from whose possession one stolen motorcycle was recovered, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan in connection with G.B. Nagar P.S. Case No.259 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
