SINHA ORAL ORDER 13-03-2015 Learned counsel for the petitioners submits that petitioner no.1 has already been arrested.

In the circumstances his anticipatory bail application has become infructuous.

Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are apprehending their arrest in connection with a case registered for the offence under Sections 341, 323, 324, 307 and 379/34 of the Indian Penal Code. So far Petitioner nos.2 and 3 are concerned, they are said to have assaulted the prosecution party with iron rod and

In the circumstances they should surrender in the Court below within a period of four weeks from the date of receipt/production of a copy of this order and pray for regular bail, which shall be considered in accordance with law. So far Petitioner nos. 4 and 5 are concerned, they are said to have assaulted the informant with bamboo sticks causing bruise injuries.

In the circumstances, let Petitioner nos. 4 and 5, named above, surrender in the Court below within a period of four weeks from the date of receipt/ production of a copy of this order in the Court below and thereafter be released on bail on furnishing bail bond of Rs. 5,000/- (Rs.Five thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya, in connection with Magadh Medical P.S.Case No. 91/2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
