Case No. 249 of 2015 for the offences instituted under Sections 302/34 of the IPC.
Heard learned counsels for the petitioner, informant and learned counsel for the State.
The prosecution story, in brief, is that while the informant alongwith his brother was sitting on a cot then one of the accused Jai Singh came and started abusing, the informant scolded and drove him out then other accused persons including the petitioners sitting on some distance also turned up on the meanwhile Ajay Singh also reached thee with knife and all other accused surrounded the informant's brothers and Ajay Singh assaulted him with knife causing injury to him as a result he
Patna High Court Cr.Misc. No.27862 of 2015 (2) dt.22-07-2015 2/2 succumbed to the injury.
It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the case. It is further submitted that on the alleged date of occurrence he was not present at the place of occurrence. It is further submitted that there is no allegation of causing any injury upon the deceased. The main allegation is against one Ajay Singh.
On behalf of the State and informant it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Bhabua (Sonhan) P.S. Case No. 249 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhabua (Kaimur), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
