====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 12-07-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in Beldour P.S. Case No. 92 of 2023 registered for the offences punishable under Sections 341, 323, 188, 427, 447, 386, 379, 504, 506, 34 of the Indian Penal Code.

3. As per the FIR, all the accused persons including the petitioner armed with weapons came at the place of occurrence and threatened to kill the informant and demanded extortion money of Rs. 50,000/-.

4. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence. No such occurrence as alleged has ever taken place. He has been falsely implicated in this case due to ulterior motive. The allegation levelled against the petitioner is totally false and

Patna High Court CR. MISC. No.23070 of 2024(4) dt.12-07-2024 2/2 based on concocted facts. He has been made accused in the present case due to old civil dispute between the parties. Petitioner is the bonafide purchaser of the land in dispute. He further submits that a Title Suit No. 72 of 2015 is pending between the parties before the learned Court below. It is further submitted that the similarly situated co-accused have been granted anticipatory bail by this Court in Cr. Misc. No. 6350 of 2024 vide order dated 20.02.2024. Petitioner has eight criminal antecedents and he is in custody since 30.12.2023.

5. Learned APP for the State opposed the prayer for bail.

Considering the submissions made as well as the fact that the similarly situated co-accused have been granted anticipatory bail by this Court, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Beldour P.S. Case No. 92 of 2023.
