JUSTICE SUDHIR SINGH ORAL ORDER 30-09-2015 Heard learned counsel for the petitioner and North Bihar Power Distribution Company Limited.

The petitioner is apprehending his arrest in a case instituted under Sections 406,420,467 and 468 of the Indian Penal Code.

The prosecution story, in brief, is that the petitioner being Project Incharge of Jyoti Structure Ltd. has committed forgery and misappropriated of government money by illegally realizing Rs. 1200-1500 from B.P.L. Consumers instead of providing free electric connection.

It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent. It is further submitted that the petitioner has been made accused due to mistake of fact. The petitioner has denied the allegation made in

Patna High Court Cr.Misc. No.27839 of 2015 (3) dt.30-09-2015 2/2 the FIR. It is also submitted that the petitioner is ready to deposit an amount of Rs. 12,000/- (twelve thousand) in the court below, which shall be subject to final disposal of the case. On behalf of North Bihar Power Distribution Company Limited it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, the petitioner is directed to deposit an amount of Rs. 12,000/-(twelve thousand) in the court below, which shall be subject to final disposal of the case. Let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Khagaria in connection with Khagaria P.S.Case No. 777/2014,G.R.No. 2763/2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
