JUSTICE ANIL KUMAR SINHA ORAL ORDER 29-06-2022 The petitioner is a tenant in the suit premises and by the impugned order, the learned trial court in Eviction Suit No. 5/2015 has directed the petitioner to pay the current as well as arrears of rent in favour of the Plaintiff-Respondent. Learned counsel for the petitioner submits that during the pendency of the suit the situation has changed and the landlord has sold the suit premises in favour of son of the petitioner.

I have gone through the impugned order and from perusal of the same it appears that admittedly there is relationship of landlord and tenant between the parties and the son of the petitioner acquiring title by way of a sale deed during pendency of suit is inconsequential in a suit for eviction between the parties.

Patna High Court C.Misc. No.188 of 2022(2) dt.29-06-2022 2/2 Accordingly, I do not find any infirmity in the order impugned.
