The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341/323/307/504/34 of the Indian Penal Code.
It is alleged that petitioner no.1 Dilip Sah assaulted with spade on the head of the informant whereas petitioner no.2 Santu Sah assaulted the informant with 'lathi'. The injury no.4 caused by petitioner no.1 has been found simple, for other injuries, the opinion kept reserved.
It is submitted by learned counsel for the petitioner that even assuming the accusation only offence under section 325 IPC is made out and there is no accusation of repeating the blow.
Patna High Court Cr.Misc. No.26757 of 2015 (2) dt.20-07-2015 2/2 The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Medni Chowki P.S. Case No.54 of 2014, pending before the learned Judicial Magistrate, 1st Class, Lakhisarai.
With the above observation, this application is, accordingly, disposed off.
