JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-07-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 342, 323, 326 and 307/34 of the Indian Penal Code. It is alleged that the FIR named accused persons including the petitioners assaulted the informant and thereafter put battery water with syringe in the eye of the informant. It is submitted by learned counsel for the petitioners that the informant was apprehended while taking away the stolen cow for which Kursakanta P.S. Case No. 127 of 2013 was registered under Sections 457 and 380/411 on 02.11.2013 at 7 AM, thereafter the present case has been lodged on the same day at 7.50 AM. It is further submitted that the informant is accused in six other cases
Patna High Court Cr.Misc. No.26584 of 2015 (2) dt.03-07-2015 2/2 and the final opinion with regard to the injury has not been recorded and accusation of making assault is omnibus and general. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Araria in connection with Kursakanta P.S. Case No. 128 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
