02-06-2016 Heard Sri N.K. Agarwal, learned senior counsel for the petitioners and learned counsel for the State.
The petitioners apprehend their arrest in relation to Musrakh P.S. Case No. 310 of 2015 registered under Sections 366(A)/34 of the Indian Penal Code. Supplementary affidavit has been filed.
Learned counsel for the petitioners states that, in fact, petitioner no. 1 has already married with the victim girl, photographs in support thereof is already on record. The Aadhar Card also shows that the husband of the victim girl is petitioner no. 1. Petitioner no. 2 who is the younger brother. He draws attention of this court that the

No.23753 of 2016 (2) dt.02-06-2016 2 / 2 anticipatory bail application filed in this court and affidavit in support thereof, as filed, victim girl showing herself to be the wife of petitioner no. 1. He submits that due to some misunderstanding between the parties, the father-in-law of petitioner no. 1 had instituted the present case which has since been compromised.
Be that as it may, in the event of their arrest/surrender before the court below within four weeks, let the petitioners, namely, Awadhesh Sahani and Sanjiv Sahani, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate - VIII. Saran at Chapra, in connection with Musrakh P.S. Case No. 310 of 2015, subject to conditions laid down under Section 438 (2) of the Code of Criminal Procedure.
