JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504, 307 and 379/34 of the Indian Penal Code.

It is alleged that the accused persons made assault to Om Prakash Sah, Ajay Sah, Dipak Sah and the husband of the informant Bindeshwari Sah and also snatched Rs. 13,000/- from his shop.

It is submitted by learned counsel for the petitioner that only Bindeshwari Sah and Ajay Sah received injury while two persons have not received any injury, though, Bindeshwari Sah has received only one injury on the scalp when the injury of Ajay Sah has been found to be simple in nature. A statement has been made in para 3 of the petition that the petitioner has no criminal

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Forbesganj (Simraha) P.S. Case No. 386 of 2013 pending in the court of learned CJM, Araria. Accordingly, the application is disposed of.
