JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Sections 143, 341, 342, 323, 498(A), 504, 506 of the Indian Penal Code.

As per the prosecution case, petitioner along with other family members committed torture on the informant due to non-fulfilment of dowry demand.

Petitioner is the brother-in-law of the informant. Learned counsel for the petitioners submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the petitioner is separate in mess and business. Thrust of allegation is against the husband of the informant who is already in custody.

Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.18825 of 2023(2) dt.18-05-2023 2/2 of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate -1st, Bikramganj (Rohtas) in connection with Dawath P.S. Case No. 116 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
