The petitioner apprehends his arrest in a case registered under Section 498 of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.
The wife made allegations of demand of dowry and torture and alleged that the petitioner drove her out after snatching her belongings.
Learned counsel for the petitioner submits that the petitioner is the husband and he is always ready to keep his wife. The wife appeared before the learned Sessions Judge but she refused to live with the petitioner.
Considering the fact that the petitioner is ready to keep his wife but the wife herself declined to live with the petitioner before the learned Sessions Judge, the above named
Patna High Court Cr.Misc. No.34773 of 2014 (2) dt.18-02-2015 2/2 petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Khagaria in Complaint Case No. 1175(C)/2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
