The petitioner apprehends his arrest in Charpokhari P.S. Case No. 191/2014, registered for the offences punishable under Sections 409, 420, 468 and 34 of the Indian Penal Code. The Block Development Officer, Charpokhari Block, Bhojpur alleged that petitioner being Panchayat Sachiv did not hand over the charge of records of the financial year 2006-2007 to 2012-2013 with regard to different schemes of Finance Commission.
Learned counsel for the petitioner submits that the petitioner was posted at Semrav panchayat in the year 2012. The former Panchayat Sachiv did not hand over the records to him and for that Charpokhari P.S. Case No. 192/2014 was registered. The
Patna High Court Cr.Misc. No.39996 of 2018 (2) dt.11-07-2018 2/2 petitioner did not receive any records from his predecessor; therefore, he could not be able to hand over the charge of any documents.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate X, Arrah, Bhojpur in connection with Charpokhari P.S. Case No. 191/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
