JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2019 This is an application for grant of anticipatory bail in connection with Itarhi P.S. Case No. 09 of 2019, disclosing offence under Section 302 of the Indian Penal Code. Allegation against the petitioner is of assault to the father of the informant, due to which he died. Submission of the learned counsel for the petitioner is that the death is due to Diarrhea by deteriorating condition of the patient due to choronic long disease and the matter has been compromised between the parties.
Heard learned A.P.P. as well as learned counsel for the opposite party no.2 also, who has opposed the prayer for bail on the ground that witnesses have supported the prosecution case in their statements before the police.
Having heard both sides, considering the above
Patna High Court CR. MISC. No.24513 of 2019(5) dt.25-06-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-II, Buxar, in connection with Itarhi P.S. Case No. 09 of 2019,, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
